Harbhajan appeal starts today

Expected to go today and tomorrow. Is being heard in the Federal Court in Adelaide.

The following quote from cricinfo shows that India will go home if the original guilty decision from the original Harbhajan hearing is not reversed.

Cricinfo, meanwhile, has learnt that the evidence provided by the stump transcripts is inconclusive - what Harbhajan says is indecipherable - and is expected to neither jeopardise nor help his case.

However, the BCCI has said that introducing new evidence at this stage was not a normal court practice. "Our lawyer has said that whatever comes to the fore in the lower court is discussed or heard by the appellate commissioner, bringing new evidence is against the rule," BCCI president Sharad Pawar told reporters in New Delhi.
The original hearing was played out under the shadow of India's threat to pull out of the tour unless the racism charge was withdrawn. There was some speculation that the threat still held, and Lalit Modi, the board's vice-president, said as much on Monday. "If the racism charge against Harbhajan is not taken back, then the Indian board has taken a decision that the team will come back to India," Modi was quoted by PTI.

This poor judge is on a hiding to none regardless of wether he judges for or against Harbhajan.

Uphold the desicion India and the Indian's will crack the ****'s

Repeal the desicion Australia and the Australian's will crack the ****'s

To top a volatile situation off there is a twenty/twenty Australia v India at the MCG on this Friday night expected crowd 90000.

This is hurtling towards a dramatic conclusion.

Blackmail, or a bluff.

In either case, the judge shouldn't let these factors influence his decision. If he decides to uphold the decision, then he shouldn't be intimidated, and if the Indians aren't bluffing then they're easily replaceable. If he decides to overturn the ruling, then everyone will just have to live with it, and cosole ourselves with the fact that Harbhajan on the Indian team gives their oponents a greater chance of success.

Just checked cricinfo and he's been cleared of racism. so i guess the tour's still on.

(Getty Images: Robert Cianflone)A charge against Indian Test spinner Harbhajan Singh for a breach of International Cricket Council (ICC) code of conduct has been downgraded at a ICC appeal hearing at the Adelaide Federal Court, according to Indian reports.
Harbhajan was found guilty of making a racist comment to Australia's Andrew Symonds under level three of the ICC's code of conduct during the second Test at the SCG earlier this month.
But following an appeal against that decision, reports from journalists in India say Harbhajan's three match suspension has been overturned and instead the spinner has been fined 50 per cent of his match fee.
Six Australian and Indian Test cricketers gave evidence in Harbhajan's appeal hearing including Symonds, Ricky Ponting, Michael Clarke and Matthew Hayden from Australia and captain Anil Kumble and batting partner at the time of the incident Sachin Tendulkar from India.
A spokesman for Cricket Australia could not confirm reports that the ban has been removed and a fine issued instead.
But he did say he believes the Indian players are making plans to fly to Melbourne for this Friday's Twenty20 international.
Earlier seven Indian one-day players abandoned preparations for their Twenty20 match at the MCG and flew to Adelaide to join the remainder of the squad as a display of solidarity for their team-mate.
The move also fuelled speculation the Indian side would boycott the upcoming one-day triangular series if Harbhajan's appeal was not overturned.
It is expected a formal announcement of the appeal result will be made shortly.

I would have been disgusted in Ponting as a captain if he failed to report an incidence of racial abuse reported to him by one of our players.

But you have a valid point the match referees original desicion is questionable due to lack of conclusive evidence.

Maybe these types of judgements need to be handled by experienced court judges full stop in whatever nation they occur in.
